Our online service is provided subject to the following terms and conditions. In terms of section 11 of the electronic communications and transactions (ECT) act 25 of 2002 and the common law of contract, these terms and conditions are valid, binding and enforceable against all persons that access the Natural Vibrance Life website (“the website”), web pages or any part thereof. If you do not agree to be bound by these terms and conditions you must leave the website without delay, as further use will automatically bind you to these terms and conditions.

E-COMMERCE, INDEMNITY & PRIVACY
The Website http://www.naturalvibrancelife.co.za sells various products online. The use of any product or service bought from this Website is at the purchaser’s risk. The purchaser/ user indemnifies and holds Natural Vibrance Life(Pty) Limited (“The Provider”), its Directors and employees harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website.
Any private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is the name, delivery address and contact phone number will be made known to third parties delivering the product. Credit card details are not retained by the Provider under any circumstances.
The Provider cannot be held responsible, and therefore assumes no responsibility, for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result, due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device or for any reason whatsoever.

PAYMENT GATEWAY

Credit Cards

Credit card payments are facilitated by Payfast (Pty) Limited, a payment service for South Africans and South African websites. Payfast accepts most major credit cards, Visa, MasterCard & Maestro (Electron). At the time of placing the order, the transaction details are presented to the bank and an authorization is obtained for the amount of the order. Payment is only collected when the order is completed and the goods shipped. Note that to protect it’s our own interests and those of our customers, Natural Vibrance Life, through Payfast, scrutinises all transactions very carefully to prevent attempted fraud and a transaction may be refused if Natural Vibrance Life or Payfast are not satisfied with its legitimacy. Card Holders may go to www.payfast.co.za to view Payfast’s security policy.

EFT Payments

Bank deposit payments via EFT are also accepted. If the buyer selects the ‘pay by EFT’ button, users will be directed to the banking details of Payfast and the sale would be subject to the following rules

  • the exact amount must be paid; and
  • the payment must be identified by supplying the order number and surname in the reference section on the electronic transfer.

Unpaid orders where the EFT payment option is selected are cancelled after 5 working days.

AGREEMENT OF SALE

An agreement of sale between Natural Vibrance Life and the User only comes into effect if and when;

  • a credit card authorisation is received from the issuing bank; or
  • a deposit of an electronic transfer is reflected on Payfast bank statement.

ELECTRONIC COMMUNICATIONS

When you visit Natural Vibrance Life or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

These do not include shipping and handling and may change without notice. While we reserve the right to charge the prices prevailing at the time the order is sent to you, we will make every effort to maintain the prices at the time you compile your order, if these are lower.

All retail prices include VAT (currently 15%)
For all South African customers, by law shipping and handling charges attract VAT at the standard rate.

OUT OF STOCK ITEMS
We try to be in stock of all featured items at all times. However, given that the products are produced outside of South Africa, there may be occasional and unpredictable shortages. If we are out of stock of your chosen item(s) at the time of your order, please re-order it at a later date.

E-MAIL COMMUNICATIONS
By visiting and using Natural Vibrance Life or sending emails to us, you are communicating with us electronically and thereby consent to receive electronic communications from us.

AGREEMENT IN TERMS OF SECTION 21 OF THE ECT ACT

The User and Natural Vibrance Life agree that:

  • the User shall be bound to these terms and conditions and such agreement is concluded in Cape Town (South Africa) at the time the User enters the website for the first time;
  • data messages (as defined in the ECT Act) addressed by the User to Natural Vibrance Life shall only be deemed to have been received if and when responded to. An auto-reply shall not constitute such ‘response’ for the purposes of this clause;
  • data messages (as defined in the ECT Act) addressed to the User by Natural Vibrance Life shall be deemed to be received by the User as detailed in section 23(b) of the ECT Act;
  • electronic signatures, encryption and/or authentication is not required for valid electronic communications between the User and the Natural Vibrance Life; and

the User agrees and warrants that data messages that are sent to Natural Vibrance Life from a computer, IP address or mobile device normally used by or owned by the User, were sent and/or authorised by the User personally.

SHIPPING

Our courier service collects from us daily at 3.00 pm. Please bear in mind that to ensure product quality, all consignments are sent by road (avoiding exposure to X-RAYS). Road shipments leave on Mon, Wed and Friday, and may take up to 72 hours to be delivered.

We are usually able to dispatch orders within four or five working days of our receiving them. This may be longer during holiday periods.

RETURNS POLICY

As per the rules and regulations set up by the Medical Control Council, we are prohibited from accepting any returns on products once they have left our premises. It is vital that you please take the time to verify your order and confirm that the items are in fact what you ordered, before making payment. Once payment has been received, we will take this as confirmation that the order is correct. Therefore in this case any order disputed by the customer, will unfortunately be the customers responsibility.

Product may be returned under the following conditions and only if Natural Vibrance Life is notified as soon as possible;

  • If incorrect products were supplied by Natural Vibrance Life (product differs from invoice);
  • Product recall from manufacturer;
  • Quality of product differs from agreed specifications;
  • Goods were damaged during transit, in which case the following procedure should be followed:
    1. Please take a picture (if possible) of the driver and the damaged boxes together.
    2. Driver and recipient must also sign on the waybill in acknowledgment that the box was delivered damaged.
    3. Contact us immediately to obtain ‘Product Return Claim Form’.

CLAIMS FOR DAMAGE OR LOSS IN TRANSIT

Claims for loss in transit and/or non-arrival must be made to us and to the carrier in writing within seven days of the expected delivery date. Claims for damage to any of the contents must be made in writing to us.

PRODUCT DESCRIPTIONS

Natural Vibrance Life attempts to be as accurate as possible. However, Natural Vibrance Life does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Natural Vibrance Life itself is not as described, your sole remedy is to return it in an unused condition.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

This site is provided by Natural Vibrance Life on an “as is” and “as available” basis. Natural Vibrance Life makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials, or products included on this site. DISPUTES

Any dispute relating in any way to your visit to the Website or to products you purchase through the Website shall be submitted to confidential arbitration in, Cape Town, South Africa, except that, to the extent you have in any manner violated or threatened to violate Natural Vibrance Life’s intellectual property rights, Natural Vibrance Life may seek injunctive or other appropriate relief in any court with competent jurisdiction in South Africa, and you consent to the exclusive jurisdiction and venue of such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the South African Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
